The most important update for this article is the Promotion and Regulation of Online Gaming Act, 2025 and the Promotion and Regulation of Online Gaming Rules, 2026.
The Act received assent in August 2025. The rules were notified on April 22, 2026 and came into force on May 1, 2026. The Online Gaming Authority of India was also constituted under the new framework.
The Skill-versus-Chance Distinction
Before this national legislation, many discussions of poker legality concentrated on whether poker was predominantly a game of skill. Teen Patti was often treated more cautiously because its fixed three-card structure gives the deal a greater influence.
That historical distinction may still be relevant to academic analysis, older cases, offline activity and state gambling legislation. It is no longer the decisive test for determining whether an online staked game falls within the central definition of an online money game.
Section 2 defines an online money game without distinguishing between skill, chance or a mixture of the two. The definition focuses on whether a user pays fees, deposits money or provides other stakes in expectation of monetary or similar enrichment.
Therefore:
- Online cash poker is not generally exempt because poker contains strategy.
- Online real-money Teen Patti does not receive a separate treatment merely because it uses different rules.

Does the Law Apply to Offshore Sites?
The central framework is intended to apply to services offered within India, including relevant online money gaming services operated from outside India.
